Week in Review – The disappointing SCOTUS oral arguments on abortion
The long-awaited arguments at the Supreme Court in the Dobbs case took place this week. The Dobbs case concerns a Mississippi law that would halt most abortions after the preborn child reaches a gestational age of 15 weeks. Previous decisions by the Supreme Court have struck down any law that sought to regulate abortion prior to “viability”—which is generally considered to occur around 23-25 weeks gestational age.
The fact that the Supreme Court even agreed to take this case under consideration was a departure from previous court procedures. Most news media attributed this to the fact that, since Trump appointed three justices, the court now has more “conservative” justices.
A full transcript of the oral arguments can be found here.
From American Life League’s perspective, these arguments all centered on the wrong question. The discussion was all about “will the Supreme Court allow states to place restrictions on abortion prior to viability?”
The real question should have been—will the Supreme Court proclaim the fact that every preborn human being is a unique human being and entitled to all the rights and protections of every other innocent human being in America?
The discussion revolved around the rights of the pregnant woman—the word “mother” was only used once in the discussion and that was by abortion rights lawyer Julie Rikelman when she maintained the Constitution does not view a woman’s primary role as a “wife and mother.” Throughout the arguments, the preborn child was almost always referred to as a “fetus.” Although this is scientifically accurate, the word distracts from the humanity of the preborn child. The word “baby” was used only once.
That was done by the pro-abortion United States Solicitor General Elizabeth Prelogar, when JUSTICE THOMAS asked her: “Would you specifically tell me what the right is? Is it specifically abortion? Is it liberty? Is it autonomy? Is it privacy?” PRELOGAR answered: “… the right is grounded in the liberty component of the Fourteenth Amendment, Justice Thomas, but I think that it promotes interest in autonomy, bodily integrity, liberty, and equality. And I do think that it is specifically the right to abortion here, the right of a woman to be able to control, without the state forcing her to continue a pregnancy, whether to carry that baby to term.”
There is much discussion going on in the press and elsewhere about the position of the various justices and whether Roe v.Wade and Planned Parenthood v. Casey will survive this current review of the court. The consensus seems to be they will not survive, even though Chief Justice John Roberts is clearly seeking a compromise that would allow the Mississippi law to stay in place while preserving Roe and Casey.
Either of these outcomes would be a failure for the preborn babies. If all the court does is overturn Roe and Casey, the fate of the preborn human beings will be left to state legislators. Thus, preborn children will still be allowed to be slaughtered in the United States. They may be safer in some states than others, but our once-great nation will still allow the murder of the innocent.

Pro-life Social Media – Abortion Violence Organizations Express Fear Over SCOTUS Hearings
There’s no such thing as an abortion that Planned Parenthood and its bloodthirsty allies find repugnant. Therefore, any encroachment on their sacred abortion cash cow is a national emergency.
This week, the court responsible for decriminalizing child murder is entrusted by many pro-life groups to recriminalize child murder. On December 1, SCOTUS heard arguments in favor of a 15-week abortion “ban” in Mississippi. Abortion titans like Planned Parenthood couldn’t contain their disgust.
The state of Mississippi has openly asked #SCOTUS to overturn Roe. Its intentions are clear.— NARAL (@NARAL) December 2, 2021
With a supermajority on the Court openly hostile to reproductive freedom, we’re at a moment of crisis—and the future of legal abortion hangs in the balance.
There’s no “middle ground” for SCOTUS to take in this case. If the Court allows Mississippi’s ban to stand, it will put abortion access at risk across the country & in the words of Justice Sotomayor, create a “stench” in the public perception of the Court. https://t.co/0bQo72sN8y— Planned Parenthood Action (@PPact) December 2, 2021
As if the public’s perception of the court is squeaky clean?
“I support abortion access because of my Catholic faith – not in spite of it. My faith teaches that healthcare is a human right — and that includes abortion.” — @jamielmanson pic.twitter.com/Nmk9Fvhlj5— Catholics for Choice (@Catholic4Choice) December 1, 2021
The heretical Catholics for Choice argues that abortion violence is sacred because self-professing Catholics get abortions.
Side note: There’s something peculiar in C4C’s video:
Can’t help watching the ASL interpreter signing ‘abortion’ while the heretical ‘Catholics’ for Choice advocates for it. pic.twitter.com/NoU40OmgoI— American Life League (@AmerLifeLeague) December 2, 2021
The 15 week abortion ban was never about protecting the health of pregnant people, but controlling their bodies. pic.twitter.com/FKKSt5SioG— ACLU (@ACLU) December 2, 2021
For the record, in 40+ years, we’ve never come across a single memo outlining a plan to “control
women’s pregnant people’s bodies.”
These groups don’t care if a preborn baby is four days old or 40 weeks old because, ultimately, they believe mothers have a right to a dead baby.
